North Dakota Proposes Bill to Protect Bitcoin Mining Rights

On January 31, Porter shared an update revealing that North Dakota Representative Nathan Toman has introduced a new bill aimed at safeguarding the rights of Bitcoin users. As confirmed by Porter, who co-founded the Satoshi Act Fund, the bill is designed to protect key Bitcoin-related freedoms, including the right to mine Bitcoin, self-custody assets, conduct peer-to-peer transactions, and operate a Bitcoin node.

Porter, a prominent advocate for Bitcoin rights, has played a critical role in introducing similar bills in various U.S. states. These initiatives often focus on protecting Bitcoin holders' rights and promoting the establishment of Bitcoin reserves.

This new bill in North Dakota follows a broader trend across the U.S. where state lawmakers are taking steps to ensure the protection of cryptocurrency activities. For example, in Montana, Rep. Lammers recently introduced a bill allowing the state to invest up to $50 million in Bitcoin and other digital assets. This was co-sponsored by Rep. Schomer. Additionally, Montana's S.B. 178, signed into law in May 2023, prohibits local municipalities from banning Bitcoin mining.

Mississippi also passed legislation in February 2023, including the "Right to Mine" bill, which defends the rights of individuals and entities to mine Bitcoin and other digital assets, while also securing the rights of node operators.

Despite this growing momentum, some states, like New York and Arkansas, have attempted to limit or ban crypto mining. In 2022, New York Governor Kathy Hochul signed a law that temporarily banned Bitcoin mining operations powered by carbon-based energy sources. Meanwhile, Arkansas has introduced bills that could restrict crypto mining activities starting in 2024.

The push for legislation protecting Bitcoin mining rights highlights the ongoing debate over how states should regulate cryptocurrency activities and whether such regulations should prioritize innovation or environmental concerns.
